To advise you of a change in the type of acceptable court orders as a result of House Bill 2741


House Bill 2741 amends Chapter 501 of the Texas Transportation Code by adding Section 501.0521. Effective September 1, 2013, a Court Order issued by a justice of the peace or municipal judge will no longer be acceptable to determine ownership of a motor vehicle, unless the order is issued pursuant to Chapter 47, Code of Criminal Procedure (Disposition of Stolen Property), or Section 27.031(a)(3), Government Code (enforcement of liens on personal property). Court Orders issued by a district court, county court, or a federal court are still acceptable.

In addition, HB 2741 prohibits a county or district court judge from issuing a Court Order that requires the department to change a Nonrepairable Vehicle Title (NVT) or certificate of authority (COA) ownership document to a Salvage Vehicle Title or an original Certificate of Title branded "Rebuilt Salvage."


Do not accept a Court Order dated September 1, 2013 or later, that changes a NVT or COA to any other title type, or that awards ownership of a motor vehicle issued by a justice of the peace or municipal judge, unless it specifies one of the statutes listed above.
