These documents contain text of correspondence sent by TxDMV to the county tax assessor-collectors, statutory agents who provide vehicle registration and titling services for citizens in Texas. This information is provided to apprise the general public of issues affecting the state's vehicle titling and registration process.

PURPOSE

To inform you of the decision to allow certain Infiniti vehicles with an odometer calibration error to continue to carry an "Actual Mileage" brand when correcting the higher odometer reading to the current lower reading.

DETAILS

Nissan model year 2007-2008 Infiniti FX35 and FX45 vehicles were improperly programmed and, as a result, their odometer systems accrued miles 3.58% faster than they should have. The National Highway Traffic Safety Administration (NHTSA) is satisfied that the proposed reprogramming by Nissan will yield the actual mileage traveled by the vehicle. Nissan, will upon request, adjust the odometer to accurately reflect actual mileage. Depending on when the vehicle's odometer is recalibrated and when the vehicle is sold, it may appear the vehicle's odometer reading should be recorded as "Not Actual."

COUNTY ACTION

If your office receives a title transfer application for an affected 2007-2008 Infiniti FX vehicle that has had the odometer recalibrated, please include a copy of NHTSA's approval letter to Nissan (attached) with the title transaction. In addition, a separate document from the Nissan franchise dealer that recalibrated the odometer must be provided by the title applicant. This documentation must include:

  • Dealer name or identification number
  • Date and description of odometer recalibration service
  • Vehicle Identification Number (VIN)
  • Pre-calibrated mileage
  • Post-calibrated mileage

If the above documentation is provided, the transaction should be processed with the odometer brand as "Actual Mileage." If the above documentation is not provided, the transaction should be processed with the odometer brand as "Not Actual Mileage."
